TERMS

Terms of Service

These Terms of Service explain the rules for accessing and using CheckInbox, including inbox placement monitoring, email scan reports, wording analysis, utility tools, accounts, subscriptions, and related services. By creating an account, accessing the platform, or using any CheckInbox service, you agree to these Terms.

Using CheckInbox

These Terms form a binding agreement between you and CheckInbox. “CheckInbox,” “we,” “us,” and “our” refer to the provider of the CheckInbox website, application, tools, reports, infrastructure, and related services. “You” and “your” refer to the person or organization accessing or using the service. CheckInbox provides email deliverability intelligence tools, including inbox placement monitoring, seed testing, email scan reports, authentication and infrastructure checks, wording-risk analysis, and related utilities such as Case Converter, UTM Builder, and Emoji tools. Some features may be free, limited, paid, invite-only, experimental, or available only to authenticated users. You may use CheckInbox only if you can legally enter into these Terms and only in compliance with applicable laws. If you use CheckInbox on behalf of a company or organization, you confirm that you have authority to accept these Terms for that organization. You are responsible for your account, login credentials, activity, team usage, test messages, uploaded or submitted content, and any configuration connected to your account. You must keep your credentials secure and notify us if you believe your account has been compromised. You agree not to misuse CheckInbox. This means you must not use the service to send spam, phishing, malware, fraudulent messages, illegal content, abusive content, deceptive campaigns, unauthorized bulk testing, or messages that violate third-party rights. You must not attempt to disrupt, overload, scrape, reverse engineer, bypass access controls, probe security, copy restricted platform logic, abuse API endpoints, or interfere with the normal operation of the service. CheckInbox is designed to help you understand deliverability risks, but it does not send marketing campaigns on your behalf unless a specific feature expressly says so. You remain responsible for your own email sending practices, recipient consent, sender reputation, domain configuration, campaign content, compliance with anti-spam laws, and all business decisions based on the reports. We may update, change, suspend, limit, remove, or discontinue any part of the service at any time. We may also apply usage limits, rate limits, storage limits, access restrictions, or technical safeguards where needed to protect the platform, users, infrastructure, providers, or legal compliance.

Reports, data, and service limitations

CheckInbox reports are informational and diagnostic. They are not guarantees of inbox placement, revenue, campaign performance, legal compliance, blacklist removal, provider approval, or future deliverability. Email filtering systems change frequently, and final placement may depend on many factors outside our control, including recipient engagement, sending history, domain reputation, IP reputation, authentication alignment, content, volume, complaint rates, provider-specific rules, and third-party infrastructure. Inbox placement monitoring uses test addresses, seed accounts, provider signals, folder classification, and available message metadata. Scan reports may analyze message headers, authentication signals, SPF, DKIM, DMARC, sender infrastructure, DNS records, blacklist-style checks, links, content patterns, and other technical indicators. Word Scanner may analyze subject lines and body text for wording that may look promotional, risky, aggressive, misleading, or spam-like. These tools provide practical guidance, not absolute truth. You understand that third-party providers may hide, transform, delay, limit, rewrite, or omit certain email headers, authentication results, message bodies, folder states, or metadata. Because of this, some results may be partial, inconclusive, delayed, unavailable, or different from what another provider or real recipient may experience. You retain ownership of the content you submit to CheckInbox, such as email subjects, message bodies, scan samples, test messages, sender details, and related data. You grant CheckInbox a limited permission to process, store, analyze, display, transmit, and use that content only as needed to provide, secure, maintain, improve, troubleshoot, and support the service. You must not submit content or data that you are not allowed to process or share. You are responsible for removing unnecessary personal data, confidential information, regulated data, secrets, passwords, private keys, payment data, health data, or sensitive information from test messages before submitting them, unless you have a lawful basis and appropriate authorization to do so. CheckInbox may process account data, usage data, email testing data, message metadata, scan results, wording analysis results, logs, security events, support communications, and technical diagnostics as described in our Privacy Policy. The Privacy Policy explains how we handle personal data and should be read together with these Terms. Some features may rely on third-party services, email providers, DNS providers, cloud infrastructure, analytics tools, payment processors, identity providers, or communication platforms. We are not responsible for third-party outages, policy changes, data delays, inaccurate third-party signals, provider restrictions, rejected messages, blocked mailboxes, suspended provider access, DNS failures, or external systems outside our control. We may send you service, account, security, billing, legal, product update, support, onboarding, and operational communications related to CheckInbox. Where permitted by law and based on your consent or other applicable legal basis, we may also send marketing, educational, promotional, or product-related communications. You can unsubscribe from marketing communications where required by law, but you may still receive essential service, security, legal, billing, and account-related messages. We may use aggregated, anonymized, or de-identified information to understand platform performance, improve scoring logic, improve product reliability, detect abuse, and enhance service quality. We will not intentionally disclose your confidential message content publicly as part of this process.

Legal terms, account actions, and contact

You may not copy, resell, sublicense, rent, lease, reproduce, redistribute, frame, mirror, clone, or commercially exploit CheckInbox or its reports except as allowed by these Terms or a separate written agreement. CheckInbox, its software, design, reports, scoring logic, interface, brand assets, trademarks, workflows, documentation, and platform structure are owned by CheckInbox or its licensors and are protected by intellectual property laws. You may use reports generated by your own account for your internal business purposes, client work, campaign review, operational decisions, and deliverability improvement. You may not present CheckInbox reports in a misleading way, remove attribution where attribution is shown, use reports to defame third parties, or claim that CheckInbox guarantees a specific inbox result. If paid plans, subscriptions, trials, credits, or usage-based billing are offered, the applicable price, billing cycle, limits, renewal rules, and cancellation options will be shown at purchase or in the account area. Unless required by law or expressly stated otherwise, fees are non-refundable once a paid period, credit package, report, or service access has been delivered or made available. We may change pricing or plan features prospectively with reasonable notice where required. We may suspend, restrict, or terminate your account or access to the service if we believe you violated these Terms, created risk for the platform, abused the service, submitted harmful content, attempted unauthorized access, failed to pay applicable fees, caused legal or security risk, violated third-party rights, used the service for unlawful activity, or if continued access could harm CheckInbox, users, providers, infrastructure, or the public. You may stop using CheckInbox at any time. Account deletion, data retention, and related privacy requests are handled according to our Privacy Policy and applicable law. Some records may be retained where needed for security, fraud prevention, billing, compliance, dispute resolution, backups, audit logs, or legitimate business operations. The service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, CheckInbox disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, error-free operation, exact deliverability prediction, and guaranteed compatibility with every email provider, campaign system, mailbox, browser, device, or workflow. To the maximum extent permitted by law, CheckInbox will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages, including loss of revenue, lost campaigns, missed inbox placement, reduced sender reputation, business interruption, lost data, lost goodwill, provider blocking, blacklist consequences, or decisions made based on diagnostic reports. To the maximum extent permitted by law, CheckInbox’s total liability for any claim related to the service will be limited to the amount you paid to CheckInbox for the service giving rise to the claim during the three months before the event that caused the claim, or USD 100 if you did not pay for the service. You agree to defend and indemnify CheckInbox from claims, damages, losses, liabilities, costs, and expenses arising from your use of the service, your submitted content, your email campaigns, your violation of these Terms, your violation of law, your violation of third-party rights, or your misuse of reports. We may update these Terms from time to time. If changes are material, we may provide notice through the website, product interface, email, or another reasonable method. Continued use of CheckInbox after updated Terms become effective means you accept the updated Terms. If any part of these Terms is found unenforceable, the remaining sections will continue to apply. Our failure to enforce a provision does not waive our right to enforce it later. These Terms, together with the Privacy Policy and any service-specific terms, form the agreement between you and CheckInbox for use of the service.
